The changes were announced by the Ministry of Housing, Communities and Local Government in January and took effect earlier this year. They expand the payments that can be disregarded when assessing pension-age claims, while separate measures cover people affected by government evacuation advice overseas.
Council Tax Reduction, sometimes called Council Tax Support, is administered locally rather than through one uniform national scheme. That means the amount a pensioner can receive depends on personal circumstances and the rules operated by their local authority.
According to Age UK, people on a low income or receiving certain benefits can obtain help from their council towards Council Tax. There is no fixed amount of support across the country, and individual councils determine the assistance available under their own reduction schemes.
Three Types of Payments Will Now Be Disregarded
The regulations introduce three new disregards for pension-age Council Tax Reduction calculations. In practice, specified payments covered by these rules will not be counted in a way that affects a claimant’s entitlement to a reduction.
According to the Ministry of Housing, Communities and Local Government, payments made through the Armed Forces Lesbian, Gay, Bisexual and Transgender Veterans Financial Recognition Scheme are now disregarded. Miscarriage of Justice Compensation payments administered by the Ministry of Justice have also been added to the list.
A third change concerns Adult Disability Allowance payments made under the Scottish Adult Disability Living Allowance Regulations 2025. These payments will not affect entitlement to a Council Tax reduction when a recipient receives them during a transitional period after moving from Scotland to England.
The Government said the changes were designed to make sure that a pension-age person’s claim is not affected by receipt of these particular payments, consistent with the wider benefits system.

The rules do not mean every state pensioner automatically qualifies for a zero Council Tax bill. The level of reduction still depends on the claimant’s circumstances and the scheme run by the relevant local council.
Council Tax Bills Can Fall to Zero in Some Circumstances
For some pensioners, Council Tax Reduction can cover the entire bill. According to Age UK, a person receiving the Guarantee Credit part of Pension Credit may have their Council Tax paid in full.
People who do not receive Guarantee Credit may still qualify for help if they have a low income and less than £16,000 in savings. The amount available can vary because each local authority operates its own Council Tax Reduction scheme.
The regulations also introduce two measures concerning people who are overseas in a country or territory where the Government has advised British nationals to leave or has arranged an evacuation. For up to six months from the date of that advice or evacuation, the requirement for working-age and pension-age claimants to be habitually resident in Great Britain before claiming a reduction is removed.
A pension-age person who normally lives in Great Britain can also receive support while temporarily absent from home for up to 26 weeks. Together with the three new payment disregards, these provisions alter how Council Tax Reduction rules apply in a small number of specific circumstances.
