While most believe they understand the rules, a substantial proportion admit to having transported children without appropriate protection.

Police Figures Reveal Thousands of Restraint Offences

According to the Manchester Evening News, Freedom of Information requests obtained by Confused.com revealed that police forces issued 5,533 fixed penalty notices between 2023 and 2025. Standard penalties were set at £100, although drivers can face fines of up to £500 for failing to ensure a child is properly restrained.

The figures also show that 2,926 motorists were directed towards retraining courses, including the National Driver Offender Retraining Scheme’s ‘Your Belt, Your Life’ programme. Another 1,808 drivers were referred for prosecution through the courts.

Greater Manchester Police recorded the highest number of fixed penalty notices, issuing 1,514 and accounting for £151,400 in penalties. West Yorkshire Police followed with 1,055 notices worth £105,500, while Merseyside Police recorded 527 notices totalling £52,700.

Other forces reporting substantial figures included the Police Service of Northern Ireland, with 310 notices, Leicestershire Constabulary with 199, and Northumbria Police with 177.

Separate research involving 1,200 parents of children under 12 revealed further concerns. Almost one in three respondents, 31%, admitted having driven with a child who was not using the appropriate restraint.

Among parents who had been stopped by police for seat-related offences, 57% reported receiving a verbal warning, while 45% were instructed to correct the problem before continuing their journey. Another 35% reported receiving a fine, and 24% faced prosecution.

UK drivers hit with £553,300 in fines over child car seat and seatbelt offences ©Canva

Many Parents Remain Unsure When Children Need Car Seats

According to Confused.com, 64% of surveyed parents did not know that children must normally use an appropriate car seat until they reach 12 years of age or 135cm in height, whichever comes first.

The research also found that 28% struggled to understand changing requirements as children grew, while 23% found choosing a suitable seat for each developmental stage difficult.

Practical difficulties were another concern. Fourteen per cent reported problems accommodating multiple child seats in one vehicle, while 20% had considered changing cars to provide sufficient space.

UK regulations require drivers to ensure children under 14 use the appropriate restraint. For height-based R129 seats, children must remain rear-facing until they are older than 15 months.
