According to the FCA, the aim is not to weaken oversight but to remove friction that adds cost for firms without improving outcomes for policyholders.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Narrowing the Scope for International Business<\/h2>\n\n\n\n<p>One of the most significant proposals concerns the territorial reach of the FCA&#8217;s insurance conduct rules, specifically <strong>ICOBS <\/strong>and<strong> PROD 4.<\/strong> Under the plans, detailed rules would only apply where there is a clear UK connection, judged by the customer&#8217;s habitual residence and, where relevant, where the insured risk is located.<\/p>\n\n\n\n<p>The FCA said this would cut down on <strong>duplication <\/strong>and reduce the chance of conflicts with regulation already in force overseas. Even so, higher-level requirements would remain, including the Principles, aside from the Consumer Duty, along with rules under the Senior Management Arrangements, Systems and Controls sourcebook.<\/p>\n\n\n\n<p><a href=\"https:\/\/uk.linkedin.com\/in\/christophercroft\" target=\"_blank\" rel=\"noopener\">Christopher Croft<\/a>, chief executive of the London and International Insurance Brokers&#8217; Association, welcomed this element of the package. He said it formalised a position the FCA had already indicated to Liiba informally, namely that its conduct and product governance rules do not apply to overseas business. The <a href=\"https:\/\/en.econostrum.info\/uk\/fca-ruling-drops-today-millions-700-payments\/\" data-type=\"post\" data-id=\"118735\">FCA <\/a>wants to strip out requirements it considers duplicative or of limited value, including elements such as ICOBS 4.2, on the basis that lengthy boilerplate does little to help customers understand what they are buying.<\/p>\n\n\n\n<p><a href=\"https:\/\/cms.law\/en\/gbr\/people\/Sarah-Brook\" target=\"_blank\" rel=\"noopener\">Sarah Brook<\/a>, a financial services partner at law firm CMS, described the reduction in mandatory disclosures as the &#8220;core benefit&#8221; of the package, noting that many such requirements have come to be seen as a <strong>box-ticking exercise<\/strong> rather than something that genuinely helps customers. Firms would also gain more flexibility in how they deliver information, including wider use of digital channels, though customers would still be entitled to receive information in a durable medium suited to their needs, or on paper if they ask for it.<\/p>\n\n\n\n<p><a href=\"https:\/\/uk.linkedin.com\/in\/cormac-bradley-990a2584\" target=\"_blank\" rel=\"noopener\">Cormac Bradley<\/a>, senior actuarial director at Broadstone, said the package reflected a move towards a more principles-based regulatory approach. As Bradley noted, the fact that many of the changes are optional was particularly welcome, since it should help avoid unnecessary implementation costs for firms that do not need to adopt them.<\/p>\n\n\n\n<p>The consultation also proposes clearer rules around advised insurance sales, removing references to &#8220;advice&#8221; in situations where no personal recommendation is being made. A separate change would convert minimum professional indemnity insurance levels for intermediaries from euros into pounds sterling, without altering the underlying minimum requirements.<\/p>\n\n\n\n<p><a href=\"https:\/\/uk.linkedin.com\/in\/graeme-reynolds-287298b\" target=\"_blank\" rel=\"noopener\">Graeme Reynolds<\/a>, the FCA&#8217;s director of competition and interim director of insurance, said the rules needed to keep pace with changing technology and consumer behaviour, adding that the proposals were designed to make regulation more flexible and proportionate for firms without affecting strong protections for UK consumers.
