Consumer Voice warns that the Financial Conduct Authority (FCA)<\/strong> risks leaving drivers \u201cstranded\u201d by not updating its advice to reflect the legal reality facing those already engaged with claims firms.<\/p>\n\n\n\n

FCA Urged to Update Guidance as Legal Claims Soar<\/strong><\/h2>\n\n\n\n

The FCA<\/strong> <\/a>is under growing pressure to revise its stance on legal representation in car finance mis-selling cases, after it emerged that around 3.8 million<\/strong> consumers have already enlisted the help of law firms. According to Consumer Voice<\/strong>, six legal firms alone are handling nearly 7.8 million<\/strong> claims, with other firms declining to disclose client numbers\u2014suggesting the true figure may be significantly higher.<\/p>\n\n\n\n

These legal agreements were largely prompted by the FCA\u2019s 2021 ban on discretionary commission arrangements, which allowed car dealers to increase their earnings by offering loans <\/strong>with higher interest rates. Though the practice was outlawed, a compensation mechanism for affected drivers was never established at the time.<\/p>\n\n\n\n

The issue has gained new urgency following a recent Supreme Court<\/strong> decision that prompted the FCA to propose a wide-ranging compensation scheme, to be formally consulted on in October<\/strong>. Until then, the FCA has maintained that consumers do not require legal representation and may cancel existing legal contracts\u2014though this could incur termination fees, depending on the work already carried out.<\/p>\n\n\n\n

While the FCA maintains that consumers can seek compensation independently, it also warns that those using legal services may see their final payouts reduced by as much as 30%<\/strong>. The regulator\u2019s \u201cblunt message\u201d advising against legal help, according to Consumer Voice, does not reflect the complexity many motorists face after signing contracts in good faith.<\/p>\n\n\n\n

The watchdog has yet to confirm whether its forthcoming redress scheme will be more advantageous than legal action, leaving consumers in a state of uncertainty.
