The DWP has acknowledged the situation but provided limited detail so far.<br><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Legal Case Exposes Loss of Severe Disability Premiums<\/h2>\n\n\n\n<p>According to a report from <em>The Mirror<\/em>, the DWP failed to adequately protect the income of disabled people who were transferred from legacy benefits to Universal Credit before transitional protections were implemented. As a result, thousands lost their Severe Disability Premium (SDP) \u2014 a component designed to support individuals with high-level care needs.<\/p>\n\n\n\n<p>A legal case brought forward by <a href=\"https:\/\/en.econostrum.info\/uk\/hs2-works-to-shut-a46-for-19-days\/\" target=\"_blank\" data-type=\"post\" data-id=\"107677\" rel=\"noreferrer noopener\">Leigh Day<\/a> solicitors prompted the creation of a large-scale compensation scheme. These payments are meant to address income losses that occurred between the date of transfer and the introduction of new income protection regulations in February 2024.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Total Cost of Compensation Reaches \u00a3452 Million<\/h2>\n\n\n\n<p>The DWP confirmed that the total cost of the repayment program amounts to <strong>\u00a3452 million<\/strong>. Lawyers involved in the case estimate that individual compensation may exceed <strong>\u00a35,000<\/strong> per claimant. The department states that more than <strong>57,000<\/strong> claimants have now received their payments, while approximately <strong>13,000 complex cases<\/strong> are still being assessed, with processing expected to conclude by <strong>September 2025<\/strong>.<\/p>\n\n\n\n<p>Importantly, compensation is calculated retrospectively. There are <strong>five monthly payment bands<\/strong>, depending on the type of legacy benefit and household composition:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>\u00a384<\/strong> for a single person with the <em>Enhanced Disability Premium<\/em><\/li>\n\n\n\n<li><strong>\u00a3120<\/strong> for a couple with the <em>Enhanced Disability Premium<\/em><\/li>\n\n\n\n<li><strong>\u00a3172<\/strong> for a single person with the <em>Disability Premium<\/em><\/li>\n\n\n\n<li><strong>\u00a3246<\/strong> for a couple with the <em>Disability Premium<\/em><\/li>\n\n\n\n<li><strong>\u00a3177<\/strong> per eligible child with a <em>disabled child element<\/em><\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Up to \u00a3180 per Month Lost Before Protections Introduced<\/h2>\n\n\n\n<p>Many claimants affected by the issue reportedly lost significant amounts \u2014 in some cases <strong>up to \u00a3180 per month before 2019<\/strong>, according to <em>Leigh Day<\/em>. These payments were never accounted for during the Universal Credit transition due to the absence of transitional protection measures at the time.<\/p>\n\n\n\n<p>In a statement to <em>The Mirror<\/em>, <strong>Ryan Bradshaw<\/strong>, a lawyer at Leigh Day, said:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><em>While we welcome the announcement of back payments, there are questions that need to be answered. There needs to be an agreed lawful calculation method in place which can be easily checked by benefits claimants who have missed out [from] up to \u00a3180 a month before 2019.<\/em><\/p>\n<\/blockquote>\n\n\n\n<p>Bradshaw also warned of troubling cases where <strong>compensation payouts inadvertently pushed claimants\u2019 bank balances<\/strong> above benefit eligibility thresholds. He described these instances as \u201c<strong>scandalous<\/strong>\u201d and indicative of systemic problems in how the DWP manages benefits administration.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">DWP Under Scrutiny for Transparency and Fairness<\/h2>\n\n\n\n<p>While <a href=\"https:\/\/en.econostrum.info\/uk\/how-the-dwps-new-policies\/\" target=\"_blank\" data-type=\"post\" data-id=\"100948\" rel=\"noreferrer noopener\">the DWP<\/a> has acknowledged the court judgment and committed to resolving all remaining cases, transparency in payment calculations remains a key concern for legal teams. Leigh Day has requested that the department publish a lawful, standardised methodology to allow claimants to verify their entitlements independently.<\/p>\n\n\n\n<p>A DWP spokesperson responded:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><em>We are fully committed to identifying and paying eligible claimants who have already moved to Universal Credit following a change in their circumstances. This is a complex undertaking and the majority of claimants affected by the court judgment have now been paid, and work is ongoing to pay all other eligible claimants as soon as possible.<\/em><\/p>\n<\/blockquote>\n\n\n\n<p>The department has reiterated its intent to process every case <strong>on an individual basis<\/strong>, using available evidence.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">How to Verify Eligibility and Make a Claim<\/h2>\n\n\n\n<p>To be eligible, claimants must have received <a href=\"https:\/\/en.econostrum.info\/uk\/universal-credit-claimants-could-get-1149\/\" target=\"_blank\" data-type=\"post\" data-id=\"111708\" rel=\"noreferrer noopener\">Universal Credit<\/a> with an <em>SDP transitional element<\/em>, or would have qualified for it had protections existed at the time. They must also have been entitled to one of the following while on legacy benefits:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Enhanced Disability Premium<\/li>\n\n\n\n<li>Disability Premium<\/li>\n\n\n\n<li>Disabled Child Premium, or <em>Child Tax Credit<\/em> with a <em>Disabled Child Element<\/em><\/li>\n<\/ul>\n\n\n\n<p>Although DWP agents are actively contacting eligible individuals, those who believe they may qualify are encouraged to submit a claim directly with supporting documentation. The DWP, now under renewed legal and public scrutiny, has reiterated its obligation to resolve all valid claims thoroughly and fairly.<\/p>\n\n\n\n<p>Legal representatives are expected to continue reviewing the case as more data emerges and individual decisions are scrutinized.
